1. Agreement to Terms
By accessing or using Raynemakr ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, don't use the Service. It's that simple.
2. Description of Service
Raynemakr is an AI-powered outbound sales platform that automates prospecting, email outreach, reply handling, and meeting booking. The Service is provided on a subscription basis.
3. Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activities that occur under your account.
4. Subscriptions and Payment
Raynemakr offers monthly subscription plans. All plans are billed monthly in advance. Prices are in US dollars. You authorize us to charge your payment method on file for the applicable subscription fee each billing cycle.
We may change pricing with 30 days notice. Price changes will not affect your current billing cycle.
5. Cancellation
You may cancel your subscription at any time with 15 days written notice. Upon cancellation, your Service continues until the end of your current billing period. No refunds are provided for partial billing periods.
6. Acceptable Use
You agree not to use the Service to:
- Send spam or unsolicited bulk email in violation of applicable law (CAN-SPAM, GDPR, CCPA, or equivalent)
- Misrepresent your identity or affiliation
- Transmit malware, viruses, or harmful code
- Violate any applicable law or regulation
- Infringe on the intellectual property rights of others
- Harass, threaten, or abuse any person
We reserve the right to suspend or terminate accounts that violate these terms.
7. Email Sending and Deliverability
Raynemakr sends emails on your behalf using your connected email account. You are responsible for ensuring your outreach complies with applicable email marketing laws. We provide deliverability tools and best practices, but cannot guarantee inbox placement. Your sending reputation is affected by your content, targeting, and recipient engagement.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of your data. We do not sell your data to third parties.
9. Intellectual Property
Raynemakr and its original content, features, and functionality are owned by Raynemakr and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
10. Limitation of Liability
To the maximum extent permitted by law, Raynemakr shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will generate any specific number of meetings, responses, or business outcomes.
12. Indemnification
You agree to indemnify and hold harmless Raynemakr from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law provisions.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
